0. Definitions
- Member
- Any individual (student, employee, agent, etc.) registered in the Platform's database. While the Platform supports up to 50,000 members per account, the actual recording capacity on a single physical device is limited by the Terminal's hardware specifications.
- User / Client
- The legal entity (school, NGO, SME) subscribing to the Presencio service.
- Terminal
- The physical device (Hikvision) used for biometric (Face/Fingerprint) or RFID recording of presence.
- Publisher
- The legal entity providing the Presencio SaaS platform and related services.
- Quota
- The maximum number of Members authorized by the current subscription.
1. Subject and Acceptance
These Terms of Service (hereinafter "ToS") govern the access and use of the Presencio SaaS platform, exclusive property of the Publisher. By creating an account, the User accepts these terms without reservation.
2. Services and Subscriptions
Presencio provides a Cloud-based attendance management solution.
- Subscription Calculation: The cost is set at $0.20 per unique Member ID registered, with a minimum charge of $20 and a maximum cap of $500 per institution per month. Headcount calculation is based on the paid quota; deleting members from the terminal does not reduce the billed count. Any attempt to synchronize a new unique Member ID exceeding this quota will be blocked by the platform.
- System Limits: One Presencio account supports up to 50,000 unique Members and up to 9 terminals (authenticated via S/N or MAC).
- Additional Service: Presencio offers a notification service by SMS, Email, or WhatsApp requiring a prepaid balance ("Credit"). Use is technically contingent upon the existence of members previously registered via the terminal.
- Access After Expiration: If the subscription expires, the reception of new attendance data is suspended, but access to consultation, existing reports, and sending notifications remains available.
3. Data Retention and Archiving
Presencio retains attendance data for a maximum period of twenty-four (24) months from the date of collection. During this period, the User may access, export, and download their data at any time.
After this period, data may be permanently deleted or anonymized without prior storage obligation. It is the User’s responsibility to ensure the archiving of any data they wish to retain beyond this period. Presencio shall not be held liable for any data loss resulting from the User’s failure to export or archive data within the retention period.
4. Hardware and Installation
- Compatibility: Requires a Hikvision terminal (DS-K1T343 series or higher), an Internet connection and Web access. Enrollment (Face, Fingerprint, or RFID Card) is performed locally.
- Offline-First: The terminal records attendance locally even without a network. Internet connection is only required for synchronization.
- Hardware Provision: Terminals can be provided by the client or purchased via Presencio (cash or staggered payment options, the latter being subject to prior evaluation and approval by Presencio, which reserves the right to approve or refuse such arrangements at its sole discretion).
- Ownership and Risks: Once the material is fully paid, the client is the owner. If the hardware is damaged (fall, sun exposure, power surges) or stolen/lost, the responsibility lies with the User. In case of theft, the client remains liable for any remaining payments. Presencio is not liable for third-party hardware failures.
- Installation: Presencio provides free initial installation assistance to ensure connectivity.
5. Biometric Responsibility and Ethics
- Consent: The User is solely responsible for obtaining legal consent from members for biometric data collection.
- Data Nature: Presencio does not store images or mathematical templates of faces or fingerprints in the cloud. Biometric processing and storage occur locally and exclusively on the physical terminal. The Cloud platform only hosts non-biometric attendance logs (User ID and timestamps).
- Enrollment: Enrollment is performed locally on the terminal. Presencio does not allow direct member addition from the SaaS interface to ensure the integrity of the biometric source.
6. Intellectual Property and Data
- Publisher Property: Source code, design, algorithms and the Presencio brand are the exclusive property of the Publisher.
- Client Data: Attendance logs belong to the client. Presencio holds the right to host and process them exclusively to provide the requested service.
7. Termination and Debts
A client can stop using Presencio at any time, provided no debt remains towards the Publisher. Presencio reserves the right to delete data from accounts expired for more than 90 days.
8. Applicable Law
These terms are governed by the laws of the Democratic Republic of the Congo (DRC). Any disputes shall be subject to the exclusive jurisdiction of the competent courts of the DRC.
